Please read these Terms and Conditions carefully before purchasing your personalized experience gift pack or email voucher. By purchasing your personalized experience gift pack or email voucher, you signify your agreement with these Terms and Conditions. Perfect Day Experiences reserves the right, in its sole discretion, to modify, alter or otherwise update these Terms and Conditions at any time and you agree to be bound by such modifications, alterations or updates.

DELIVERY
You have a choice of delivery options for your Perfect Day Experiences gift:
Email Voucher delivery, which is dispatched as soon as your order is complete.
Gift Pack delivery options (Canada Only):
Standard Delivery: Your personalized experience gift pack will be sent in plain packaging, via Standard Post which is 3-7 business days.

Please Note: If you have selected for your experience voucher to be delivered by email, please note that it is possible that some email accounts may class Perfect Day’s vouchers as unwanted email or spam. If you do not receive your email voucher from Perfect Day please ensure that you check your email spam or junk folders in case the voucher has been inadvertently redirected there.

Moreover, Perfect Day Experiences is not liable or responsible for any loss suffered as a result of an email gift voucher not being received. If the recipient does not receive the email voucher(s) they must contact us immediately on 1-866-575-6810 and ask for the email to be sent to an alternative email address.

SEASONAL
Last order dates, delivery times, opening hours and courier charges may change over seasonal periods, i.e. Christmas & New Year. For seasonal variations see our website or email our Customer Service Desk.

EXPERIENCE DESCRIPTIONS
Perfect Day Experiences does not provide the experience; these services are provided by the venue, which is solely responsible for the provision of the experience.

The information provided by Perfect Day Experiences is correct at the time of going to print. However, the content or format of experiences may change over time. Details of each experience are available from our Customer Help Desk and are included in the gift pack. Your participation is conditional on your acceptance of the experience description details on Perfect Day Experiences' website and in your gift pack.

EXPERIENCE PICTURES
The pictures used in all promotional literature to illustrate experiences, particularly those that take place at more than one location, are indicative only.

EXPERIENCE VENUES
The Perfect Day Experiences' network of suppliers includes many of Canada's best experience venues. We are always adding to the locations we offer, but occasionally may need to withdraw venues featured for reasons beyond our control. If your chosen location is withdrawn, you will be offered alternative venues wherever possible. However, it is likely to be at a different location or with a different experience supplier. Each venue has its own terms and conditions (available upon request) and your participation is conditional on your acceptance of these.

SESSION LENGTHS
Session lengths are approximate, vary from venue to venue and are given simply as an indication of the time you will spend at the venue. Unless stated otherwise, you will usually be taking turns with other people and there may be waiting time involved. Itineraries are given as a guide only and the running order of an event may change.

RESTRICTIONS
Certain experiences are subject to minimum or maximum requirements, e.g., age, health or weight. These are clearly detailed in the experience description on our website. Once booked, you may be liable for charges if you have to cancel because the minimum requirements have not been met. Full details are included in your gift pack and we ask you to read this carefully as soon as you receive it.

WEATHER
Many Perfect Day Experiences' sessions are dependent on the weather and we will advise you if you need to call to check the weather before setting out. Should your experience be cancelled by the supplier due to the weather you will be able to re-book, bearing in mind of course that your re-booked experience remains subject to weather conditions. Refunds cannot be given due to weather cancellations.

AVAILABILITY
All experiences are offered subject to availability.  The most recent information on when an experience is available may be found on our website or by emailing our Customer Service Desk.  We will always do our best to secure your preferred choice of dates.  To help this, please book as early as possible and in any event at least 21 days in advance and further for weekends or holiday periods.  Bookings are not confirmed until you receive confirmation in writing from Perfect Day Experiences.  You should not make any arrangements in connection with your experience until this confirmation is received.

Where specific elements of the experience such as vehicles or celebrities are not available due to mechanical breakdown or illness, Perfect Day Experiences reserves the right to make reasonable substitutions on the day. Should this not be possible, we reserve the right to cancel the experience at short notice, should this be necessary an alternative date or full refund will be offered.

INCLUSIVITY
We welcome the participation of disabled people in our experiences though we recognize that certain experiences may present difficulties. We are committed to ensuring that disabled customers are given every opportunity to participate, so we ask that you tell us about any relevant disability at the time of ordering, thus enabling us to do our best to meet the participant's particular needs. We will be happy to provide information about the disabled facilities available at specific venues on request.

COMPLAINTS
We welcome your feedback on all our experiences. If you have a problem or complaint on the day, please bring it to the attention of the host or experience manager at the venue as soon as possible, so they have a chance to put matters right. In general, we consider it unreasonable if you take no action during an event, but then write a letter of complaint at a later date.

VOUCHER CONDITIONS
All Perfect Day Experiences gift packs contain a voucher which is evidence of payment for a given experience. Except as specified herein, the payment is non-refundable. Each voucher shows a reference and security code which must be quoted when dealing with Perfect Day Experiences, and which will be used to identify your payment. Vouchers and the associated reference must be kept safely and securely. Perfect Day Experiences will take no responsibility for any loss you may incur as a result of impersonation or identity fraud.

Voucher Expiry Dates
The voucher expiry date for experiences will be detailed in your gift pack or email voucher and will be nine months from date of purchase - your experience must be booked and taken within this time.

If your voucher has expired you may reinstate it within 12 months of the original expiry date for an administration fee of $50 (plus tax) at the time of booking the experience. You will also have to pay any applicable experience price increase. After this time the voucher will no longer be valid.

Promotions, Hot Deals and Specials
Experience vouchers that were purchased as part of a promotion, Hot Deal or special cannot be extended or reinstated after their original expiry date.

Freedom Vouchers do not expire.
Freedom Vouchers allow the recipient to choose from a selection of experiences. Please note that the selection detailed at the time of purchase may change from time to time.

When a choice of experience is made, the payment associated with the Freedom Voucher will be applied to the purchase of the specific selected experience. New references will be issued to you, which must be used in future dealings with Perfect Day Experiences.

REFUNDS (Except Freedom Vouchers)
If you wish to return a gift you purchased, you must do so within 28 days of your purchase. All refunds must be requested by the original purchaser and all monies will be remitted only to the original purchaser. All refunds are made via a Perfect Day Experiences company cheque. No refunds are allowed once a Perfect Day Experience is booked. Any refund requests received more than 28 days from the purchase date will not be considered. Refunds are not granted on shipping costs, therefore Gift Packs and their original method of shipping will be deducted from refundable amounts.

FREEDOM VOUCHER REFUNDS
Freedom Voucher refunds within 28 days of purchase will be charged a $35.00 (plus tax) admin charge. Any refund requests received more than 28 days from the purchase date will not be considered. Refunds are not granted on shipping costs, therefore Gift Packs and their original method of shipping will be deducted from refundable amounts.

EXCHANGE POLICY

If you have received an experience that doesn't interest you, you may exchange it for a Perfect Day website credit to use towards purchasing an alternative experience.

Please note: exchanges are only permitted on unbooked experiences. A voucher may be exchanged once without attracting a fee - all subsequent voucher exchanges will incur a $15 administration fee per voucher.

If you exchange for an experience of lesser value, any remaining balance will be held in credit on your account and subject to the same expiry date as the original voucher.

Exchanged vouchers and any resulting website credits will expire on the same date as your original voucher.

BOOKINGS & CANCELLATIONS

Once your booking has been made, if you cancel it, you may incur a cancellation fee from the supplier involved. You must contact the supplier directly with any cancellation requests as Perfect Day is not able to handle these on your behalf. You will also be required to deal directly with the supplier should any re-scheduling of your experience be necessary due to bad weather or other unforeseen circumstances – you will have full supplier contact details in your confirmation email that you received from Perfect Day at the time of your original booking.

Our suppliers operate under their own cancellation policies which you will need to adhere to. In the case of short notice cancellations you may lose your voucher completely if the supplier is unable to fill your space on the day. If a supplier needs to cancel a service for any reason, you will be notified as soon as possible in order to reschedule a convenient alternative date. Perfect Day Experiences will not reimburse any traveling, accommodation or other expenses incurred by you or any other person in the event of a cancellation.

If Perfect Day Experiences makes changes to your confirmed booking on your behalf you will be charged a $25 administration fee.

FUEL SURCHARGES
Due to unprecedented rises in fuel prices you may be asked to pay a fuel surcharge, imposed on us by our partners, when redeeming for a fuel-related experience. We do endeavour to secure pricing that is not fuel sensitive, but significant fuel price increases may have an impact.

If a surcharge is imposed and you would rather not pay it then you will have the option of exchanging your experience for another experience of your choice for the same value from perfectday.ca – there will be no administration charge payable for this exchange. Any fuel surcharge costs will not be cause for a refund, only an exchange.

INSURANCE
Participation in some experiences may involve an element of risk and your Gift Pack is purchased in the knowledge of this. The Perfect Day Experiences Help Desk can provide further information on experiences if you are in doubt. Ultimately, our experience venue operators have control of the experience on the day over which Perfect Day Experiences has no influence. Whilst it is required by Perfect Day Experiences that all venue operators must have current public liability and/or third party insurance and be fully conversant with and comply with all necessary health and safety requirements, you should make independent enquiries as to the need to acquire your own insurance over.

DISCLAIMER OF WARRANTIES
You expressly understand and agree that:
a. Your use of the service is at your sole risk. The service is provided on an "as is" and "as available" basis. Perfect Day Experiences expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
b. Perfect Day Experiences makes no warranty that (i) the service will meet your requirements, (ii) the service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the service will be accurate or reliable, and (iv) the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations.
c. No advice or information, whether oral or written, obtained by you from Perfect Day Experiences or through or from the service shall create any warranty not expressly stated in these Terms and Conditions.

Limitation of liability
You expressly understand and agree that Perfect Day Experiences shall not be liable to you for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damage to your property, injury to your person or another participant of the gift pack, and financial losses (even if Perfect Day Experiences has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the service; (ii) the cost of procurement of substitute goods and services resulting from any goods, information or services purchased or obtained or transactions entered into through or from the service; (iii) statements or conduct of any third party on the service; or (iv) any other matter relating to the service.

OTHER TERMS AND CONDITIONS
Prices are plus applicable taxes (HST or GST) and are correct at the time of going to print. However, we reserve the right to increase the price of any experience without notice. You will be notified of any new price before your booking is confirmed.

Whilst we take every care in choosing our experience suppliers, inclusion of an experience in our range does not mean that we guarantee the safety standards or satisfactory performance of any of the experience suppliers.

Perfect Day Experiences' liability for any claim of breach of obligation regarding any single voucher or experience shall not exceed the price of that experience.

The testimony, illustrations and pictures used in all Perfect Day Experiences promotional literature are protected by copyright and must not be copied in whole or in part without the express permission of Perfect Day Experiences Ltd.

All the above terms and conditions apply as a condition of using any voucher, whether or not the voucher holder is the original purchaser.

Perfect Day Experiences reserves the right to change these terms from time to time without reference to customers.
